GENERAL BOOKING CONDITIONS:

 

 

Information prior to booking:

These General Booking Conditions (hereinafter General Conditions) will regulate the commercial relationship that arises between Ignacio Coli Planas and the user or client for the booking made through the forms that Ignacio Coli Planas makes available on his website https://canignasi.es/

Booking through the websites owned by Ignacio Coli Planas entails an express and full acceptance by the client or user of the webpages of the present conditions, as well as the conditions of use established for the navigation of the user through the webpages owned by Ignacio Coli Planas.

These conditions shall be applicable without prejudice to the application of the legal regulations on the matter that are appropriate in each case.

The General Conditions regulate the distance booking relationship between Ignacio Coli Planas and the user or client in accordance with the corresponding legal stipulations. In particular: Law No. 7/1998 of 13 April 1998 on General Contractual Conditions; Law No. 3/2014 of 27 March which modifies the revised text of The General Consumer And User Protection Act; Organic Law No. 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights; General Data Protection Regulation (EU) 2016/679; Retail Trade Act, Law No. 7/1996 of 15 January; and Law No. 34/2002 of 11 July on E-Commerce and Information Society Services.

Ignacio Coli Planas reserves the right to make any modifications he deems appropriate to the General Conditions without prior notice. Said modifications may be made through his websites by any legally admissible means and shall be binding for as long as they are published on the website and until they are validly revised by subsequent modifications. However, in certain cases, Ignacio Coli Planas reserves the right to apply Particular Contractual Conditions in preference to the aforementioned General Conditions when he deems it appropriate, announcing them in due time and form.

All contents of the website are in Spanish, Catalan, English and German.

By booking through Ignacio Coli Planas website, the user or client expressly declares to know, understand and accept these conditions of use and the General Conditions. Likewise, the user or client declares to be of legal age and to have the necessary legal capacity to access the Ignacio Coli Planas websites and to make a booking through them. The user is responsible for keeping confidential the identity and password obtained when registering as a customer and may not transfer them to a third party.

Once the booking has been made, a confirmation will be shown on the webpage. The confirmation can be printed as proof of the booking. Likewise, the user will receive an email confirming the booking. The booking confirmation and the booking receipt (printout made by the user) will not be valid as an invoice.

 

 

BOOKING PROCEDURE

 

 

Booking offer and price reference:

In compliance with current regulations and in particular with Law No. 34/2002 on E-Commerce and Information Society Services, Ignacio Coli Planas offers information on available bookings, their characteristics and prices in the booking corresponding section. However, Ignacio Coli Planas reserves the right to withdraw, replace or change the products or services offered to his customers through his website by simply changing the content of such offers. In this way, the products and/or services offered at any given moment by the Ignacio Coli Planas website will be governed by the General Conditions in force in each case. Likewise, the company shall have the right to stop offering access to the aforementioned products and/or services without prior notice and at any time.

 

Price guidelines:

Every booking offered will have its price indicated in Euros and whether VAT or any other applicable tax is included. The prices indicated on the website will be those in force at any given time, except in the case of typographical errors. If the price is different for the aforementioned reason, the error will be corrected at the time of booking confirmation upon arrival at the establishment.

 

Availability:

The availability of the products and/or services offered by Ignacio Coli Planas through his website may vary depending on customer demand. The database of https://canignasi.es/ is updated instantly as bookings are made, thus confirming availability at the time of booking and therefore payment.

 

Payment methods:

Ignacio Coli Planas requests in the bookings made through his website the details of a credit or debit card and booking holder to guarantee the booking. The restaurant makes a charge of 20,00€ on the client’s credit card when making a booking. This amount is blocked on the client’s card and returned at the time of confirmation of the booking upon arrival at the restaurant. The establishment reserves the right to check the validity of the credit card before the arrival of the client.

The invoice corresponding to the booking will be settled directly at the restaurant either in cash, by credit card or by any other means accepted by the restaurant.

 

Cancellation of the booking:

If the cancellation is made more than 48 hours in advance the restaurant will make a charge of 5,00€ as a website management fee. If the cancellation is made with less than 48 hours’ notice, the restaurant will be entitled to charge the credit or debit card provided for the full amount withheld for the booking, i.e. 20,00€.

On the other hand, the courtesy time will be of 30 minutes and in case of not being able to attend it is necessary to warn in advance. The courtesy time refers to the time in which the table will be kept, after the reservation time, until the customers arrive.

 

Withdrawal:

According to the provisions of Article 103 of Law No. 3/2014 of 27 March which modifies the revised text of The General Consumer And User Protection Act, supplies of services or goods made according to the consumer’s specifications or clearly personalised, or which by nature cannot be returned, may deteriorate or expire rapidly are exempt from withdrawal.

 

 

DATA PROTECTION:

 

 

In accordance with the applicable and current regulations on data protection, Ignacio Coli Planas informs users that the personal data collected during the registration and/or booking process will be incorporated into the processing system owned by Ignacio Coli Planas. The aim is to store such processes by the user and manage subsequent actions arising from them.

The personal data collected will be kept without a deletion date in order to keep a record of bookings and payments made in compliance with the legal obligation. Likewise, the stored contact details will not be used for advertising or commercial purposes. We inform you that the legal basis for the processing of your data is the correct execution of the contract between the parties and with consent.

Ignacio Coli Planas also reserves the right to bring any civil or criminal action he deems appropriate for the improper use of his website and content or for breach of aforementioned conditions. The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their disputes to arbitration or recourse to ordinary jurisdiction in compliance with the rules of jurisdiction and competence in this regard.
